Granparents and Child Custody
We all know the fact that grandparents are able to get custody rights. This can happen in different circumstances and the entire topic is much more complicated that you might believe. Custody is received by both or just one parent. In some specific cases grandparents can gain the rights.
For the grandparents to gain custody rights there is a need for a court to be completely convinced that grandparent visitation is suitable for the child. For instance, if there is an accident and the injuries that both parents suffered will stop them from taking care of the child grandparents might receive parenting rights. Disputes wil appear in the event that courts will decide that both parents lose custody rights. Unfortunately this is one type of event that is actually quite common nowadays. Grandparents receive child custody if:
- Parents simply abandon their rights as parents
- Parents will abandon the child
- There are clear and disturbing problems in the parent-child relationship
- There is no safety environment provided by the parents for their children
- Parents turn out to be dangerous, abusive and hurt children
When just one parent loses parental rights we find the other one as sole guardian. If both the father and the mother lost parental rights then they are usually given to a member of the family that can provide safety. This includes grandparents in the event that they can offer a good growing up environment. If you do want to be a guardian of the child then you have to be prepared for one legal process that is long. Courts always want to make sure that children are taken care of. The one factor that is really important is the educational needs that have to be covered. If just one of the parents will lose his right to be a parent then one grandparent can easily turn into co-guardian.
